YOU MUST CONSENT TO AND ABIDE BY THESE TERMS OF SERVICE AND USE BEFORE GAINING ACCESS TO LAKEHEAD UNIVERSITY'S EMAIL SYSTEM.
(1) Lakehead University offers email service on an "as is" and "as available"
basis without any implicit or explicit guarantees of service. In return
for access to and use of this service each person (the "End User") who
holds a Lakehead University email account agrees to release and hold
harmless Lakehead University and Google Inc. from any and all liability
for any loss, damage, injury or expense due to any cause whatsoever
including negligence, libel, breach of contract or breach of copyright,
patent, trade mark or other intellectual property or breach of any
statutory or other duty of care suffered in consequence of the End User
using this email service and further agrees to hold harmless and indemnify
Lakehead University and Google Inc. from any and all liability for any
loss, damage, injury or expense due to any cause whatsoever including
negligence, libel, breach of contract or breach of copyright, patent,
trade mark or other intellectual property, or breach of any statutory or
other duty of care suffered by a third party in consequence of the
End User's use of this email service.
(2) By using Lakehead University's e-mail system, every End User will be deemed
to have consented to abide by all terms and conditions of the following
Lakehead University policies, all of which are easily accessible on the
web:
(a) the Use of University Computers Policy at https://www.lakeheadu.ca/about/policies-procedures
(b) the Code of Computing Practice at https://www.lakeheadu.ca/about/policies-procedures
(c) the Policy Regarding Devices Connected to the Lakehead University
Network at https://www.lakeheadu.ca/about/policies-procedures, and
(d) the Password Policy at https://www.lakeheadu.ca/about/policies-procedures
(e) the Email Policy of Lakehead University at https://www.lakeheadu.ca/about/policies-procedures.
(3) In particular, every End User shall not, shall not agree to, and shall not
authorize or encourage any third party to
(a) use this email service to upload, transmit or otherwise distribute any
content that is unlawful, defamatory, harassing, abusive, fraudulent,
obscene, contains viruses, or is otherwise objectionable on a
reasonable determination;
(b) upload, transmit or otherwise distribute content that infringes upon
another party's intellectual property rights or other proprietary,
contractual or fiduciary rights or obligations;
(c) prevent others from using this service; or
(d) use this service for any fraudulent, criminal, or other inappropriate
purpose.
(4) Every End User must also abide by all terms of Google Inc.'s'
"Gmail Terms of Use" at https://www.google.com/mail/help/terms_of_use.html.
(5) Lakehead University will make reasonable efforts to maintain the integrity
and effective operation of its electronic mail systems, but users are
advised that those systems should not be regarded as a secure medium for
the communication of sensitive or confidential information. Because of
the nature and technology of electronic communication, the University can
assure neither the privacy of an individual user's use of the University's
electronic mail resources nor the confidentiality of particular messages
that may be created, transmitted, received, or stored thereby.
(6) The University may access and disclose the contents of faculty, staff,
students', and other users' electronic mail without the consent of the user
only:
(a) to the extent required by law, including the Freedom of Information and
Protection of Privacy Act of Ontario (RSO 1990) (FIPPA); or
(b) to the extent permitted by law, and
when the University believes that it has a legitimate business need
including, but not limited to, the following:
(i) in the course of an investigation triggered by indications of
misconduct or misuse; or
(ii) to protect health and safety; or
(iii) to prevent interference with the academic mission; and
after explicit authorization is obtained from the appropriate University
authority.
Users are advised that the University's electronic mail systems should be
treated like a shared filing system, i.e. with the expectation that
communications sent or received on University business or with the use of
University resources may, in the circumstances defined above, be made
available for review by any authorized University official.
(7) All student End Users should be aware that the personal information that
they provided in their applications for admission to Lakehead University
has been collected under the authority of the Act Respecting Lakehead
University (Statutes of Ontario, 1965). The University will use and
disclose it as shall be necessary for purposes of admission, registration,
and other decisions on students. academic status, and the administration
of the University and its programs and services. In addition, this
information may be disclosed to the Lakehead University Student Union and
the Alumni Association of Lakehead University to the extent that it is
necessary for their essential operations, and will be reported to the
federal and provincial governments as required by law. Also, personal
information in relation to program enrolment, graduation, and awards may
be made public. Any questions about the collection, use, and disclosure
of personal information should be directed to the Director of Risk
